VILLAGE OF MILLERTONLOCAL LAW NO. A (Proposed) OF 2022A Local Law to Abolish the Village of Millerton Police Department and Replacewith Contracted ServicesBe it enacted by the Board of Trustees of the Village of Millerton as follows:SECTION 1. LEGISLATIVE INTENTIt is the intent of this local law to abolish the Village of Millerton Police Department. TheVillage has determined that entering into a shared services agreement with Dutchess Countywill reduce its tax levy and the attendant burden on Village taxpayers while still providing theVillage with professional police protection. The Board of Trustees finds that abolition of theVillage Police Department is in the public interest.SECTION 2. AUTHORITYThis local law is adopted pursuant to NYS Village Law § 8-800, which expressly authorizes avillage to abolish its police department.SECTION 3. ABOLITION OF POLICE DEPARTMENTThe Board of Trustees of the Village of Millerton, Dutchess County, hereby abolishes its policedepartment. All police services and functions shall be transferred by a contract for policingservice with the Dutchess County Sheriff’s Office or any such entity with whom the Villagesubsequently validly contracts.SECTION 4. SEVERABILITYThe provisions of this local law are severable. If any provision of this local law or theapplication thereof to any person, firm, corporation, or circumstance is adjudged invalid by acourt of competent jurisdiction, such order or judgment shall not affect or impair the validity ofthe other provisions of this local law or the application thereof to other persons andcircumstances.SECTION 5.
