In this episode, we are speaking with the newest member of the Albany Law faculty, Professor Jacob Victor, who is an expert in intellectual property and technology law.  Professor Victor joined the law school on July 1. As a tenure-track faculty member at Albany Law School, Professor Victor will teach intellectual property-related courses and first-year property; develop a program for students interested in innovation- and technology-focused careers; serve as faculty advisor to the Innovation Intensive apprenticeship clinic, an experiential opportunity offered in partnership with the Research Foundation for SUNY and SUNY Polytechnic Institute; and continue his research on how intellectual property law is adapting to the digital age. Meet Prof. Jacob Victor

In this episode, Jacob Victor, Assistant Professor of Law at Albany Law School and Affiliated Fellow at the Yale Information Society Project, discusses his article "Utility-Expanding Fair Use," which will be published in the Minnesota Law Review. Victor begins by explaining what "utility-expanding" fair use is and how it differs from other kinds of "transformative" fair use. He reflects on when and why courts tend to find that utility-expanding uses are fair, and observes that the fair use doctrine might not always be the best solution. He suggests that compulsory licensing may offer an alternative method of encouraging utility-expanding uses of copyrighted works, better suited to some circumstances.
